
In a curiously timed public hearing, TVA has announced its intention to add coal ash to the gypsum landfill being built on the banks of the Clinch River. This landfill has already failed several times and has even leached gypsum into the Clinch River, we are just finding out. The public hearing was after the December County Commission meeting and the public comment period ends before the next Commission meeting in a very transparent attempt to force this through before anybody finds out about it.
We are calling on County Executive Ron Woody and the County Commission to get involved and stop this travesty. The first thing is to demand an extension of the comment period for 90 days so all the facts can come out. They won't be pretty.
TDEC is currently headed by former TVA Attorney, Bob Martineau, who the fought NC Attorney General's lawsuit to force TVA to clean up its coal ash emissions.

TVA and a lapdog TDEC are asking the people of Kingston TN to trust them, since nothing could possibly go wrong with their plan to landfill coal ash illegally close to the Clinch river. Of course that's what they said last time when TDEC failed to protect Kingston from TVA's ineptitude prior to the 2008 coal ash disaster, and now, just as the Clinch, Emory, and Tennessee river environments have recovered, they want to start it all over again.
This is a slap in the face for every property owner who saw their resale values crushed after the 2008 disaster and TVA refuse to make them whole, even after the judge ruled TVA responsible for the damage, because the law is written so TVA doesn't have to be responsible to all of those it harms.

It is difficult to see how the just released EPA regulations can possibly be bent to allow such a thing. Some of the points that are violated are:
· Reducing the risk of catastrophic failure by requiring regular inspections of the structural safety of surface impoundments;
· Restrictions on the location of new surface impoundments and landfills so that they cannot be built in sensitive areas such as wetlands and earthquake zones;
· Protecting groundwater by requiring monitoring, immediate cleanup of contamination, and closure of unlined surface impoundments that are polluting groundwater;
· Protecting communities using fugitive dust controls to reduce windblown coal ash dust;
· Requiring liner barriers for new units and proper closure of surface impoundments and landfills that will no longer receive CCRs.

The Roane County news reporter, Damon Lawrence completely dropped the ball on this.
Lawrence isn't the only one that dropped the ball.
This isn't a curiously timed public hearing. In my opinion is a small part of a master plan to get a landfill in place before the public has a chance to react and before the EPA made it's ruling. Some of the best minds in the waste industry were probably consulted to help orchestrate this plan.
Lawrence isn't the only one that dropped the ball on this. Roaneviews and the citizens of Roane Country dropped the ball as well. I made it clear what was happening on the banks of the Clinch 13 weeks ago and no one seemed to care. Below is a link that will refresh your memory. I have also quoted the comments I made at that time. I'm afraid the ship has sailed on this one. To be honest, I don't think many people who are not within sight of this landfill will care. I've been down this road before.

I don't get paid to do this. Damon does. What is new here are the waivers, without which it would be impossible to put coal ash in this landfill. We did not know about that. Everyone that received the press release of last Thursday's public meeting did.

I don't blame you or RoaneViews. Even if the County Mayor, County Commission and the general public were to come out against this, (in my opinion they won't), there is little chance of doing anything to stop this landfill. This is intended to be a replacement for the wet landfill that collapsed. It is a done deal unless someone like the governor wanted to stop it. The county mayor, county commission and all the rest of us are just nimbies to the people who make the decision on a landfill of this magnitude. All we can do at this point is stir up the attention of the media and make it worse on ourselves in the long run.

Roles and responsibilities
What is the role of the Environmental Review Board in this matter? Who is responsible for keeping the public informed?
I have yet to see the
I have yet to see the Environmental Review Board take any relevant action on any of the TVA issues. They should be informing themselves and the County Commission as to what this means.
Visibility
The ERB submitted comments to TVA on various documents when the public/stakeholders were invited to do so. It would appear that the ERB's position on issues needs to be communicated to the county commission and the public so they have better visibility.
As a citizen and area resident, I need to know who to turn to when I have a question that needs to be addressed by local government. It's time for people to step up to establish a strong, transparent mechanism to communicate on matters pertaining to human health, wildlife, and the environment. Sounds like a good new year's resolution!

At each county commission
At each county commission meeting there is time set aside for anyone who wishes to address the commission. It is usually shortly after the meeting has started. If there is something on the agenda that you wish to address, one of the commissioners can recognize you to speak at that time if you hold your hand up. It's best to talk to one of them before the meeting if you want that to happen.
The timimg of this is highly suspect
The information as to what was actually happening here was made after the December Commission meeting and the public comment period ends before the January meeting. I wonder how the Kingston City Councilmen will feel when they realize that a fifteen story pile of coal ash will be staring back at them from their City Hall building?

Environmental media
I am equally concerned about all environmental media (air, soil, ash, groundwater, surface water, river sediment) and bioaccumulation in the food web with its implications for fish, turtles, and other aquatic and terrestrial biota that people eat. We can be grateful that there will be ongoing monitoring and research at the spill site for the foreseeable future (30 years). Now all we have to do is figure out how to get monitoring results in a timely manner going forward.

I promise to oppose every elected official who doesn't immediately and publically call for this to be stopped!
