Agee said there are a total of "at least 200 and possibly 350" plaintiffs seeking damages in the lawsuits. The suits seeking jury trials and TVA's motions asking that they be thrown out are pending before U.S. District Court Judge Tom Varlan.

KINGSTON (WATE) -- Many Roane County homeowners are suing the Tennessee Valley Authority in the wake of the 2008 ash spill, but only a few are still living in their homes.
Phyllis Ellis is one of the homeowners who stayed.
"One year later, you have hoped for the best but haven't received the best," says Ellis. She lives on Swan Pond Road next to the Kingston coal fired power plant.

I don't know if it's the same suit but I just got a letter saying the tva motions to throw out were granted in my case.
Was that letter from your attorney?
However, my attorney said recently that he expected a ruling any day.
